Centre de la protection internationale is a human rights organization dedicated to the protection of human rights and freedoms of individuals in Council of Europe countries both directly and by assisting, collaborating with, and supporting the civil society in these countries, especially where it is under pressure and lacks independence to take actions.

В ноябре этого года группа российских правозащитников выступила с инициативой публичного обращения ко всем заинтересованным сторонам по проблеме кризиса во взаимоотношениях Совета Европы и Российской Федерации. В своем обращении авторы подчеркивают, что этот кризис достиг той точки, в которой угроза выхода России из Совета Европы – по собственной инициативе или в результате её исключения – представляется более чем реальной.
По мнению инициаторов обращения, возможный выход России из организации повлечет за собой серьезные и далеко идущие негативные последствия, причем не только для российского общества, но и для Европы в целом, и при этом не окажет позитивного влияния на действия российских властей в отношении Украины, что послужило основной причиной кризиса в отношениях с Советом Европы.
Авторы подчеркивают, что выход России из Совета Европы не остановит нарушения прав человека и не предотвратит дальнейшее сползание нашей страны к авторитаризму, а также не повлияет на агрессивное поведение нашего правительства на международной арене. Этот шаг положил бы конец трудной борьбе российского гражданского общества за то, чтобы наша страна стала важной частью Европы на основе общих норм и ценностей демократии, верховенства закона и уважения прав человека.
Стремление «наказать» российские власти за нарушения обязательств путем исключения из Совета Европы бьет мимо цели: от этого пострадает не правительство России, а российский народ. В течение 20 лет Европейский суд по правам человека дает миллионам живущих в России людей надежду на справедливость, которой во многих случаях они не могут добиться внутри страны. Тысячи решений Суда оказали значимое положительное воздействие на российское законодательство и судебную практику. Авторы настаивают – при всех тяжелых проблемах с правами человека в нашей стране, ситуация была бы намного хуже, если бы Россия не являласьчленом Совета Европы с 1998 года. Если Россия выйдет из организации, масштабы проблем в области прав человека в стране вырастут в геометрической прогрессии, включая перспективу скорого восстановления смертной казни.
Одновременно с этим, выход России из Совета Европы никоим образом не будет способствовать разрешению конфликта на востоке Украины, возвращению Крыма под украинскую юрисдикцию и освобождению украинских политзаключенных из российских тюрем. При этом возможности критического диалога лицом к лицу с представителями России в рамках этой общеевропейской организации будут потеряны.
Инициаторы обращения призывают все стороны найти в ближайшее времярешение, которое не будет являться отступлением от ценностей и принципов Совета Европы, но позволит ему и дальше выполнять свою миссию по продвижению и защите демократии, верховенства права и прав человека во всей Европе, включая Россию.
На настоящий момент под обращением подписалось более 60 российских правозащитников, адвокатов, экспертов в области права и журналистов, пишущих на темы прав человека.
Navalnyy v Russia
Today the European Court of Human Rights found the Russian Federation in violation with Articles 5, 6, 11 and, most importantly, Article 18 read in conjunction with Articles 5 and 11 of the Convention. For the first time the Court found violation of Article 18 in conjunction with Article 11. The Court emphasized that “[a]t the core of the applicant’s Article 18 complaint is his alleged persecution, not as a private individual, but as an opposition politician committed to playing an important public function through democratic discourse. As such, the restriction in question would have affected not merely the applicant alone, or his fellow opposition activists and supporters, but the very essence of democracy as a means of organising society, in which individual freedom may only be limited in the general interest, that is, in the name of a “higher freedom” referred to in the travaux préparatoires. The Court considers that the ulterior purpose thus defined would attain significant gravity.” (Navalnyy v Russia, nos. 29580/12 and 4 other applications, para. 174 (emphasis added))
